Sunrise at Fountain Square accused of negligence in woman's care

CHICAGO — A deceased woman's family has filed a wrongful death claim against Sunrise at Fountain Square, alleging negligence in nursing home care, liability and insufficient measures taken to prevent injuries.

Samuel Martel, individually and as independent administrator of the estate of Doris Martel, filed a complaint in Cook County Circuit Court against Sunrise Senior Living Management Inc., which operates Sunrise at Fountain Square, alleging that the nursing home failed to properly evaluate Doris Martel's fall risk.

According to the complaint, the plaintiff alleges that in 2015, Martel suffered multiple falls, a situation that contributed to her death. The plaintiff holds the defendant responsible for allegedly failing to implement a care plan to address Doris Martel's risk of falling, as well as failing to provide adequate supervision.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000. He is represented by Jonathan M. Thomas of Power Rogers & Smith, P.C. in Chicago.
