Presence Resurrection Medical Center blamed in fall that broke man's neck

CHICAGO — A deceased man's family is suing Presence Resurrection Medical Center in a wrongful death claim alleging the hospital didn't do enough to prevent the man from falling and breaking his neck.

Marta Mikolowicz, as independent administrator of the estate of Stefan Mikolowicz, filed a complaint on Oct. 3 in Cook County Circuit Court against the defendant, alleging that the hospital failed to provide proper medical care to Stefan.

According to the complaint, the plaintiff alleges Stefan sustained physical injuries in a fall, including an impacted acute left femoral neck fracture that contributed to his death. The plaintiff holds the defendant responsible for allegedly failing to provide adequate supervision to Stefan or implement a care plan to address his risk of falling.

The plaintiff seeks judgment against the defendant in an amount greater than $50,000. She is represented by Andrew J. Thut and Jacob D. Radecki of Levin & Perconti in Chicago.
