Elmhurst Orthopaedic accused of improper care in connection with infection

CHICAGO — A patient is suing Elmhurst Orthopaedic, S.C., and John Nikoleit, M.D., alleging negligence in connection with post-surgery infection.

Gregory Smith filed a complaint on Oct. 6 in Cook County Circuit Court against the defendants, alleging that he did not receive proper medical care.

According to the complaint, the plaintiff alleges that in 2014, he suffered severe and disabling physical injuries as a result of an infection following knee surgery. The plaintiff holds the defendants responsible for allegedly failing to properly evaluate his condition and determine that he was not an appropriate candidate for surgery.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000. He is represented by Stephen S. Phalen of Law Offices of Stephen S. Phalen LLC in Chicago.
