Class action says Fabfitfun, associates distribute promo gift cards with too-short expiration periods

CHICAGO — A woman has filed a class action lawsuit against Fabfitfun Inc., Merrithew International Inc., Physique 57 International Inc., Reeds Jewelers Inc., d/b/a The Jeweler's Wife, and Zumba Fitness LLC, alleging sales of gift cards with unreasonably short expiration periods.

Julia Byerson filed a complaint on Oct. 11 in Cook County Circuit Court against the defendants, alleging that buyers of the cards face unreasonably short periods of use before expiration.

According to the complaint, the plaintiff alleges that she suffered damages from purchasing a gift card with a relatively short expiration date. The lawsuit alleges the defendants profited from allowing consumers to purchase their gift cards knowing that the expiration periods were so short that consumers wouldn't use them before expiration.

The plaintiff requests a trial by jury and seeks an injunction against the defendants, restitution, disgorgement, compensatory and punitive damages, actual damages and statutory damages, court costs plus interest and any further relief the court grants.
