Lexington of Orland Park accused of failure to supervise properly

CHICAGO — A deceased man's family is suing Lexington Health Care Center of Orland Park Inc., alleging negligence in nursing home care.

Anthony Vivacqua, as independent administrator for the estate of Constantino Vivacqua, filed a complaint on Oct. 14 in Cook County Circuit Court against Lexington Health Care Center of Orland Park Inc., d/b/a Lexington of Orland Park, alleging that the nursing facility failed to provide proper care to Constantino Vivacqua.

According to the complaint, the plaintiff alleges that Constantino Vivacqua suffered multiple falls, which contributed to the deterioration of his health. The plaintiff holds the defendant responsible for allegedly failing to provide adequate supervision to Constantino Vivacqua in order to address his risk of falling.

The plaintiff seeks judgment against the defendant in an amount greater than $50,000 plus court costs. He is represented by Bella Feinstein of The Law Offices of Steven J. Malman & Associates, P.C. in Chicago.
