Chicago Drinking Co. accused of overserving customer in leadup to alleged assault

CHICAGO — A man is suing Chicago Drinking Co. Inc., and various individuals, citing alleged assault, battery and negligence.

Richard Balabuszko filed a complaint on Dec. 28 in Cook County Circuit Court against the defendants, alleging a man was overserved at the AJ Hudson's bar and subsequently attacked the plaintiff.

According to the complaint, the plaintiff alleges that on Dec. 26, he suffered serious physical injuries including lacerations to his face and dislocation and fracture of his left leg when he was assaulted by a man who had been a customer at an establishment where he was overserved alcohol and for which the other defendants were allegedly liable. The plaintiff holds his alleged assailant responsible for the alleged assault and the other defendants responsible for allegedly overserving his assailant with alcohol, leading to the assault.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds the jurisdictional limits of this court, plus court costs and any further relief this court grants. He is represented by Hesik Prybylo Law Offices in Oak Park.
