Emergency Room Providers says hospital, competitor colluded to 'poach' hospitalists

CHICAGO — A medical personnel staffing firm is suing Advocate Trinity Hospital and United Elite Hospitalists LLC, citing alleged breach of contract.

Emergency Room Providers S.C. filed a complaint on May 15 in Cook County Circuit Court against the defendants alleging they subverted plaintiff's staff to interfere with its business.

According to the complaint, the plaintiff alleges the defendants colluded to "poach" physicians, including hospitalists, trained and under contract with ERP,  as Advocate terminated its staffing contract with the plaintiff in favor of a contract with ERP's competitor, United Elite. The complaint further alleges Advocate did not pay ERP recruiting fees, as purportedly required under its contract.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000 plus court costs and any further relief this court grants. It is represented by John R. Ostojic of Ostojic & Scudder LLC in Chicago.
