CHICAGO — An insurance company is suing GT Transport Inc., Grainco FS Inc. and Grace Shaw, special administrator of the estate of Anthony Lincoln, alleging it has no liability in lawsuit involving a fatal allergic reaction.
Century National Insurance Company filed a complaint on June 26 in U.S. District Court for the Northern District of Illinois, alleging GT Transport was seeking insurance coverage for its alleged liability in a lawsuit regarding the death of Lincoln, who allegedly died from an allergic reaction to soy beans in a Grainco facility.
According to the complaint, the plaintiff alleges GT Transport had requested insurance coverage for its liability in the suit. The plaintiff argues the incident in question is not covered by GT Transport's business auto insurance policy.
The plaintiff asks the court to declare it owes no duty to defend the defendant and court costs. The plaintiff is represented by Michael J. Duffy and Abigail E. Rocap of Wilson Elser Moskowitz Edelman & Dicker LLP in Chicago.
