Leak & Sons Funeral Home accused of burying corpse without family's consent

CHICAGO — Three family members are suing Leak & Sons Funeral Home and Spencer Leak & Sons Funeral Home Ltd. for alleged intentional infliction of emotional distress and negligence.

Monique Williams, Dominique Rutledge and Albert Rutledge filed a complaint on Oct. 31 in Cook County Circuit Court, alleging the defendants switched the remains of Ella Rutledge with another deceased individual.

According to the complaint, the plaintiffs allege that they went to the funeral home to claim the body of their deceased relative and make arrangements for the wake and burial when they discovered the relative was already buried. The plaintiffs hold the defendants responsible for allegedly switching Rutledge's corpse with that of another deceased individual.

The plaintiffs request a trial by jury and seek judgment against the defendants for an amount greater than $50,000 plus court costs. They are represented by Evan M. Smola of Hurley McKenna & Mertz in Chicago.
