Life Time Fitness accused of collecting employee fingerprint scans without consent

CHICAGO — An employee has filed a class-action lawsuit against Life Time Fitness Inc. and LTF Club Operations Company Inc. for alleged invasion of privacy and violation of state law.

Alexander Marshall filed a complaint on Oct. 26 in Cook County Circuit Court, alleging the defendants captured and stored their employees' biometric information without consent, scanning employee fingerprints to more accurately record employee work hours. The plaintiff holds the defendants responsible for allegedly failing to inform their employees, including the plaintiff, in writing why their biometric information was being collected and for how long will they will keep the information stored in their systems.

The plaintiff requests a trial by jury and seeks injunctive and equitable relief, statutory damages of $5,000, statutory damages of $1,000 for each negligent violation of Biometric Information Privacy Act (BIPA), court costs, interest and any further relief this court grants. He is represented by Myles McGuire, Evan M. Meyers, and David L. Gerbie of McGuire Law P.C. in Chicago.
