Pulmonetic Systems Inc. allegedly developed defective ventilator

CHICAGO — A man is suing Pulmonetic Systems Inc., Viasys Healthcare Inc., Cardinal Health Inc., Carefusion Inc., Becton Dickinson and Co., and Total Home Health for alleged liability, negligence and product liability.

Eliu Perez, special administrator of the estate of Eliu Perez Jr., filed a complaint on Nov. 7 in Cook County Circuit Court, alleging that the defendants manufactured a ventilator that was found to be defective.

According to the complaint, the plaintiff alleges Perez Jr. suffocated while using the ventilator since it was not pumping air. The plaintiff holds the defendants responsible for allegedly failing to place an alarm system on the ventilator in case the unit was defective and did not pump air while being used.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000. He is represented by Edward G. Proctor Jr. of Munday & Nathan in Chicago.
