Thorek Memorial Hospital allegedly failed to prevent patient from being sexually abused

CHICAGO — An estate representative is suing Thorek Memorial Hospital for allegedly taking insufficient measures to prevent injuries.

James Doe, plenary guardian for the estate and person of John Doe, filed a complaint on Nov. 22 in the Cook County Circuit Court, alleging that the defendant failed to provide John Doe with proper care while he was being treated at its facility.

According to the complaint, the plaintiff alleges that John Doe sustained emotional distress from being sexually battered and sexually exploited. The plaintiff holds the defendant responsible for allegedly failing to adequately supervise John Doe in order to prevent him from being sexually abused.

The plaintiff seeks judgment against the defendant in an amount that exceeds the jurisdictional limits of this court. He is represented by Kristin Barnette McCarthy of Kralovec, Jambois & Schwartz in Chicago.
