SunOpta Grains and Food Inc. accused of supplying contaminated sunflower kernels

CHICAGO — Several companies are suing SunOpta Grains and Food Inc. for alleged negligence, demanding the company pay more than $16 million for supplying conatiminated sunflower seeds, which were recalled and destroyed.

Treehouse Foods Inc.; Bay Valley Foods LLC; Flagstone Foods Inc.; Treehouse Private Brands Inc.; and Lloyds's Syndicate CVS 1919, subrogee of Treehouse Foods Inc., filed a complaint on Nov. 20 in Cook County Circuit Court, alleging the defendant failed to properly check and test the sunflower kernels it supplied to the plaintiffs.

According to the complaint, the plaintiffs allege they were forced to recall and destroy contaminated sunflower kernel products at their facilities. The plaintiffs hold the defendant responsible for allegedly allowing its sunflower kernel products to be contaminated before sending it to the plaintiffs.

The plaintiffs request a trial by jury and seek judgment against the defendant in the amount of $16.1 million, plus interest and any further relief this court grants. They are represented by Philip T. Caroll of Cozen O'Connor in Chicago.
