Skyhawks Sports Academy Inc., others allegedly refused to pay commission

CHICAGO —  A company is suing Skyhawks Sports Academy Inc., Dave Berto, Jeff Heimbigner and Chris Stiles, citing alleged breach of contract.

Chapman Associates General Business Inc. filed a complaint on April 18 in Cook County Circuit Court, alleging that the defendants breached their listing agreement by allegedly failing to pay it a 10 percent commission.

According to the complaint, the plaintiff alleges it entered into an exclusive listing agreement with the defendants for a period of one year that allegedly granted the plaintiff the exclusive rights to sell 29 of its franchise territories for $4.5 million, plus a minimum commission of 10 percent of the total consideration. However, without the plaintiff's knowledge, the defendants allegedly purchased the entirety of the academy and refused to give the plaintiff the 10 percent commission they allegedly had agreed to in the contract. 

The plaintiff requests a trial by jury and seeks judgment in an amount of $1.2 million or an amount proven at trial, plus costs and attorney's fees. The plaintiff is represented by Wesley E. Johnson of Goodman Tovrov Hardy & Johnson LLC in Chicago.
