El Capitan Restaurant & Lounge Corporation accused of negligence after bouncer allegedly assaulted patron

CHICAGO — A man is suing a restaurant, citing alleged battery and negligence.

Bartolome Godinez-Perez filed a complaint on April 25 in Cook County Circuit Court against El Capitan Restaurant & Lounge Corporation, alleging that the defendant failed to provide a safe environment for its patrons.

According to the complaint, the plaintiff alleges one of the defendant's bouncers struck him and used physical violence to restrain him. As a result of the alleged incident, the defendant claims that he sustained severe and permanent injuries, mental anguish and medical expenses.

The plaintiff requests a trial by jury and seeks judgment for damages in an amount greater than $50,000 and the costs of the suit. He is represented by Charles R. Culbertson of Rubin, Machado & Rosenblum LTD in Chicago.
