Casey Equipment Company, VT LeeBoy Inc. accused of negligence after fatal paver accident

CHICAGO — A widow is suing Casey Equipment Company Inc. and VT LeeBoy Inc. for alleged negligence and liability in connection with her husband's death in an accident on a construction site.

Catherine J. Eiler, independent administrator of the estate of Jack D. Eiler, filed a complaint on May 11 in Cook County Circuit Court, alleging the defendants violated the Illinois Wrongful Death Act.

According to the complaint, the plaintiff alleges her husband was thrown from a paver and then run over and crushed by it while at work. The paver allegedly was manufactured by VT LeeBoy and sold to Eiler's employer by Casey Equipment Company. 

The plaintiff claims her husband died as a result of his injuries and she and her children have lost the companionship and services of a husband and father. The plaintiff holds the defendants responsible for allegedly failing to provide adequate safeguards to prevent his death.

The plaintiff requests a trial by jury and seeks judgment for an amount greater than $50,000, plus costs. She is represented by Thomas K. Prindable and Michael J. Pullano of Cogan & Power PC in Chicago.
