Sears sues Electrolux over damage to store after refrigerator allegedly overheated, caught fire

CHICAGO — Several businesses are suing Electrolux North America Inc., Electrolux Home Products Inc. and John Does and Jane Does 1-5 for alleged negligence, breach of contract, breach of express and implied warranties, consumer fraud, gross negligence and strict product liability.

Sears Hometown and Outlet Stores Inc., Innovel Solutions Inc., Sears Roebuck & Company, Sears Holdings Corporation and Liberty Mutual Fire Insurance Company filed a complaint on May 10 in Cook County Circuit Court, alleging one of their buildings was damaged by a fire that allegedly was caused by an overheated refrigerator the defendants manufactured. 

The plaintiffs hold the defendants responsible for allegedly failing to properly design, assemble, test and inspect their products; assure that there were no hazardous hidden defects in their products; and sell products without sufficient safety guards in order to prevent a short circuit.

The plaintiffs request a trial by jury and seek judgment against defendants for damages in an amount that exceeds $50,000, plus interest, attorney fees, the costs of the lawsuit and all other proper relief. They are represented by Alyssa J. Endelman of Denenberg Tuffley PLLC in Southfield, Mich.
