F.H. Fashen, others allegedly failed prevent woman from suffering fatal injuries at construction site

CHICAGO — An estate administrator is suing F.H. Fashen, S.N. Nielsen & Associates LLC, F.H. Faschen, S.N. Nielsen Inc., Parsons Brinckerhoff Inc. and WSP USA Inc. for allegedly taking insufficient measures to prevent injuries.

Melva Hendrix, administrator of the estate of Pearl Hendrix, filed a complaint on May 15 in Cook County Circuit Court, alleging the defendants violated the Illinois Wrongful Death Act.

According to the complaint, the plaintiff alleges Pearl Hendrix, a former flagman for the Chicago Transit Authority, was caused to trip and fall on an electrified construction site, which allegedly caused her to sustain fatal injuries. As a result, Hendrix's family allegedly has suffered the loss of society, counseling, love, affection, care, attention and comfort of a family member. The plaintiff holds the defendants responsible for allegedly failing to properly manage, supervise, oversee and control their construction site.

The plaintiff requests a trial by jury and seeks judgment in an amount greater than $50,000, plus the costs of the suit. She is represented by Colin J. O'Malley of Goldberg Weisman Cairo in Chicago.
