Symphony South Shore resident claims employee assaulted her

CHICAGO — A resident is suing a medical facility and physician, citing alleged assault, breach of duty and negligence.

Lois Rivers filed a complaint June 13 in Cook County Circuit Court against Symphony South Shore LLC, MS South Shore LP and an employee, alleging, while she was a resident at the defendants' facility for physical therapy and rehabilitation after suffering two strokes, she was allegedly punched in the face, neck, head and upper body by the employee on Oct. 18, 2017.

Rivers claims she was assaulted without provocation, which caused her to fall from her bed onto the floor and put her in fear of imminent bodily harm after the incident. 

As a result, Rivers claims she suffered pain and a delay in her rehabilitation and incurred expenses for medical care. 

The plaintiff requests a trial by jury and seeks a judgment in an amount greater than $50,000, as well as $500,000 in punitive damages, reasonable attorney's fees, costs and other relief the court deems just and proper. She is represented by Drake James Leoris Jr. of Leoris & Cohen PC in Highland Park.
