Plaza at Countryside seeks payment of $109,332 from tenants

CHICAGO — A shopping center owner is suing tenants Benderson Properties Inc., Benderson Development Co. and First Berkshire Properties LLC, citing alleged breach of contract.

Plaza at Countryside LLC filed a complaint June 19 in Cook County Circuit Court, alleging Plaza at Countryside suffered monetary loss as a result of the defendants' default on payments on their share of a contribution toward the costs of operation, maintenance and repair or improvements of common areas. The plaintiff said these amounts were owed under a construction, operation and reciprocal easement agreement.

In addition to allegedly failing to meet their agreed payment terms, the plaintiff said the defendants forced it to retain and pay for the services of legal counsel to address the default.

The plaintiff requests a trial by jury and seeks a judgment of no less than $109,331, plus interest, expenses, court costs and attorney's fees. It is represented by Nicholas Lykins of Johnson & Bell Ltd. in Chicago.
