CHICAGO – A Texas man alleges he was injured by a prescription drug used to treat gout.
Keith Utley filed a complaint on Sept. 28 in Cook County Circuit Court against Takeda Pharmaceutical Co. Limited and Takeda Pharmaceuticals USA Inc., alleging strict liability and negligence.
According to the complaint, in 2009, Utley's treating medical physician prescribed him Takeda's drug Uloric to treat gout.
The plaintiff alleges as a direct result of consuming Uloric, he experienced dyspea, acute blood loss, volume overload, acute renal kidney failure and acute gouty flare and stopped taking Uloric in 2017.
The plaintiff holds Takeda Pharmaceutical Co. Limited and Takeda Pharmaceuticals USA Inc. responsible because the defendants allegedly concealed their knowledge of Uloric's defects from the public, the Food and Drug Administration and the medical community and represented that the product had been tested and was found to be safe and effective for its intended uses.
The plaintiff requests a trial by jury and seeks judgment in an amount in excess of the court's jurisdictional limits. He is represented by Allen N. Schwartz of Kravolec, Jambois & Schwartz in Chicago.
