CHICAGO – A Winter Park, Fla., couple are suing Rush University Medical Center, Zimmer Biomet and others over an allegedly defective knee implant surgery.
Joanne Adams and Larry Adams filed a complaint on Dec. 17 in Cook County Circuit Court against physicians Richard A. Berger and Hassan Alosh, Rush University Medical Center, Midwest Orthopaedics at Rush LLC, and Zimmer Biomet Inc. alleging negligence and other counts.
According to the complaint, in December 2014, Joanne Adams underwent total knee replacement surgery at Rush University Medical Center, performed by Berger and Alosh. The suit states they used a Zimmer NexGen knee implant device despite knowledge of its flawed design and receipt of an urgent device correction and removal notice from the U.S. Food and Drug Administration.
The plaintiffs allege the medical device was ineffective, defective and dangerous and failed to perform in a manner that a reasonable consumer would expect it to perform.
The plaintiffs request a trial by jury and seek judgment against defendants for compensatory damages, with costs and all other relief the court determines just. They are representing themselves.
