CHICAGO — An insurer is suing a man who allegedly resisted arrest in Northlake, as the insurer seeks to collect reimbursement of workers' compensation benefits paid to an officer who was injured in the incident.
The Illinois Public Risk Fund, through the Northlake Police Department, filed a complaint on Feb. 1 in Cook County Circuit Court against John A. Cottone, alleging the defendant breached his duty of reasonable care and seeking reimbursement to plaintiff of workers' compensation benefits.
According to the complaint, on March 6, 2017, Illinois Public Risk Fund provided $121,920 in workers' comp to Northlake Police Officer Jake Pollard for injuries he reportedly sustained while attempting to arrest Cottone, who resisted. Pollard was placed on disability leave.
The plaintiff requests a trial by jury and seeks $121,920, plus attorney fees, expenses incurred, and other relief. The insurer is represented by James Messineo of James Messineo & Associates in Inverness.
