CHICAGO — A man is suing an Evanston rehabilitation facility, alleging the facility's negligence contributed to a relative's death.

John Evans, independent executor of the estate of Robert Evans, filed a complaint on March 13 in Cook County Circuit Court against Symphony of Evanston Healthcare LLC and physician Beatrisa Paz Averbuch.

In the complaint, Evans accuses the defendants of overdosing Robert Evans with pain and sedative medications in October 2017, contributing to his death.

The defendant is accused of negligence and breach of duty.

The plaintiff is seeking more than $50,000, plus attorney fees and court costs. The plaintiff is represented by Jason M. Kellerman of The Law Office of Steven J. Malman & Associates P.C. in Chicago.
