Avantara Park Ridge brings class action vs Advancare over faxed ads

CHICAGO — The operator of a Park Ridge rehabilitation facility has filed a class action lawsuit against a home health care provider, alleging the sending of junk faxes.

Avantara Park Ridge LLC, individually and as the representative of a class of similarly situated persons, filed a class action complaint Aug. 28 in Cook County Circuit Court against Advancare Healthcare Services LLC, alleging violation of the Telephone Consumer Protection Act. The complaint said Advancare advertised its home health care and nursing services.

According to the complaint, Avantara received unsolicited faxes from Advancare, which the plaintiff said was harmful and wasteful as it clogged up the ability of its fax machine to be used for legitimate communications and used up the plaintiff's paper and ink. 

Avantara Park Ridge seeks $500 for each violation, awards and other relief. It is represented by attorney Brian J. Wanca of Anderson + Wanca in Rolling Meadows.
