Class action accuses Four Seasons Heating & Air Conditioning of violating IL biometrics law

CHICAGO — An employee has brought a class action lawsuit against a Chicago heating and air conditioning business, alleging they violated an Illinois biometrics privacy law.

Kevin Truss, individually and on behalf of others similarly situated, filed a class action complaint Aug. 20 in Cook County Circuit Court against Four Seasons Heating & Air Conditioning Inc., alleging violation of the Illinois Biometric Information Privacy Act.

According to the complaint, Truss was employed by Four Seasons and, during the course of his employment, he was required to clock in and out using biometric information. The suit alleges the company violated the Illinois BIPA law by requiring workers to scan their biometric information to verify their identity before the company obtained express authorization from the workers or before the company provided notices allegedly required by the BIPA law.

Truss seeks statutory damages of $1,000-$5,000 per violation, plus interest, attorney fees and other relief. The plaintiff is represented by attorneys Brandon M. Wise and Paul A. Lesko of Pfeiffer Wolf Carr & Kane APLC in St. Louis.
