LITTLER MENDELSON PC: The COVID-19 Vaccine – Legal and Practical Implications

Littler Mendelson P.C. recently issued the following announcement.

The Advisory Committee on Immunization Practice (ACIP) meets several times a year at the Centers for Disease Control and Prevention (CDC) to review scientific data and vote on vaccine recommendations. On December 1, 2020, the ACIP recommended that health-care personnel and residents of long-term care facilities receive the coronavirus (COVID-19) vaccine during the initial phase. The Food and Drug Administration (FDA) must approve the applicable vaccines, and emergency relief authorization is under way. The vaccination program will significantly expand as vaccines become more widely available.

The legal landscape involving vaccination programs in the employment setting has evolved over the years, particularly in health care, which may provide a "road map" in addressing many of the issues dealing with the COVID-19 vaccine. There are, however, many unique and evolving issues tied to the COVID-19 vaccine.

Topics covered during this webinar will include:

An update on priorities for distribution of the vaccine and the manner in which such decisions will be made

A review of the legal issues that need to be addressed in any vaccination program developed by employers

Requests to be excused from vaccination programs based on (1) religious beliefs, practices, or observances under Title VII of the 1964 Civil Rights Act or (2) medical conditions and/or disabilities covered under the Americans with Disabilities Act
