With the arrival of the Biden administration, employers have seen a substantial increase in OSHA enforcement activity, including a forthcoming emergency standard for COVID-19 likely to be released in mid-March. This will mark the first time OSHA has issued regulations related to the pandemic and follows on the heels of numerous states who have already issued COVID-19 regulations.

Additional regulations will increase the risk of whistleblower claims being filed – a number that has already been steadily increasing across the country. As employers take steps to protect against whistleblower claims and private actions, they must also guard against the threat of state attorney general enforcement actions that allege inadequate protection of employees from COVID-19.
