CHICAGO — A driver has filed a negligence lawsuit after another driver allegedly ran a stop sign and crashed into her vehicle at the four-way intersection of Kostner Avenue and 99th Street in Oak Lawn.
According to a complaint filed in Cook County Circuit Court, on Aug. 8, 2023, plaintiff Carol O'Shea was driving northward along Kostner Avenue near its intersection with 99th Street in Oak Lawn, which is an intersection controlled by four-way stop signs. O'Shea claims that after obeying the stop sign at the intersection, she had the right of way when she proceeded through the intersection, and her vehicle was struck by defendant Marvin Jones, who was driving westbound along 99th Street. Jones had allegedly bypassed a car ahead of him and entered the intersection without stopping at the stop sign.
Jones is accused of several acts of negligence, including failing to yield right of way, failing to maintain a proper lookout, failing to execute evasive maneuvers required to prevent the collision, operating his vehicle recklessly, and general carelessness.
O'Shea claims to have sustained injuries as a result of the collision. She is seeking damages in excess of $50,000 for pain, suffering, mental distress, and other personal and pecuniary damages, plus court costs and any other relief the court deems proper.
