Negligence lawsuit filed following traffic collision at intersection of Harlem Avenue and Dempster Street in Niles

CHICAGO — A negligence lawsuit has been filed against a driver who allegedly failed to yield the proper right of way when entering the intersection of Harlem Avenue and Dempster Street in Niles, causing a vehicle collision.

According to the complaint filed in the Cook County Circuit Court, on Sept. 15, 2022, plaintiffs Michael J. Lammersfeld and Vicki A. Brady claim that they were traveling southbound on Harlem Avenue near its intersection with Dempster Street in Niles when their vehicle was struck by defendant Paul D. Scianna's vehicle. Scianna was allegedly driving northbound on Harlem Avenue and turned left without yielding the right-of-way to Lammersfeld's vehicle approaching from the opposite direction.

Scianna is accused of several acts of negligence, including driving at a speed greater than reasonable for conditions, failing to keep a proper lookout, failing to yield proper right-of-way, failing to equip his vehicle with proper brakes, failing to stop when danger was imminent, failing to change course to avoid striking another vehicle, and general negligence.

The plaintiffs claim to have sustained serious bodily injury due to this incident. They are seeking damages in excess of $50,000 for pain, suffering physical impairment, disability, and medical expenses, plus court costs. 

The plaintiffs are represented by the attorneys of the Law Office of Daniel E. Goodman, LLC in Rosemont.
