Jonathan Moscovitch sues Westfield and Snow Systems for negligence leading to personal injury

Jonathan Moscovitch has filed a lawsuit against Westfield, LLC, Westfield America G.P., Inc., Westfield Property Management, LLC, Snow Systems, Inc., and Old Orchard Urban Limited Partnership in the Appellate Court of Illinois, First Judicial District. The court case ID is 1-22-1453 and the date of filing is March 12, 2024. The plaintiff alleges that he suffered serious injuries due to negligence on the part of the defendants in maintaining their property during winter conditions.

Moscovitch's claim stems from an incident on January 17, 2020, when he slipped and fell on an accumulation of snow and ice outside a restaurant at the Old Orchard shopping mall in Skokie, Illinois. His injury required surgery which included the placement of a metal plate and screws in his shoulder. The plaintiff sued not only the owner of the shopping mall but also Snow Systems, Inc., the snow-removal company contracted by the mall owner.

The snow-removal contractor moved for summary judgment, arguing that they had fulfilled their contractual obligations with the mall owner. They maintained that they had complied fully with their duties as outlined in their contract with Westfield Property Management, LLC. The trial court agreed with this assessment and entered summary judgment in favor of Snow Systems.

Moscovitch is seeking damages for his injuries and loss resulting from what he claims was negligence on part of all defendants. He asserts that they failed to ensure safe conditions at their property during winter weather which led to his accident.
