Brian Sesto has filed a lawsuit against Pilkington North America, Inc. in the United States District Court for the Northern District of Illinois, under case ID 1:24-cv-03149, on April 19, 2024. The suit is a personal injury claim resulting from a roof collapse incident that occurred on November 2, 2022.

Sesto's legal representation is Parente & Norem, P.C., while Pilkington North America, Inc., incorporated in Delaware and headquartered in Ohio, was doing business in LaSalle County at the time of the incident. The plaintiff was working for Marseilles Sheet Metal Company on a construction project at an Ottawa property owned and operated by the defendant when he sustained severe injuries due to a roof collapse.

The plaintiff alleges that the concrete roof had a latent defect which neither he nor his employer were warned about by Pilkington. He claims that this oversight led to his fall and subsequent injuries. The damages are significant enough to exceed $75,000 - the minimum amount for this court's jurisdiction.

In his lawsuit, Sesto seeks judgment against Pilkington North America for failing to maintain safe working conditions and not stopping work despite potential dangers. He also points out that at all relevant times there was an ordinance (Article 8, Section 22-300) in effect in Ottawa which regulates conditions and maintenance of all properties.
