Daniel Catalan sues C&M Baling Systems Inc. for negligence and breach of duty

In the Circuit Court of Cook County, plaintiff Daniel Catalan has filed a lawsuit against C&M Baling Systems, Inc., and C&M Baling Systems Holdings, LLC., both North Carolina corporations. The case, bearing ID 1:24-cv-03065, was filed on April 17, 2024.

Represented by Cogan & Power, P.C., Catalan alleges that on August 8, 2022, he suffered severe injuries due to a malfunctioning industrial baler manufactured and sold by the defendants. The incident occurred at Claire's manufacturing plant in Hoffman Estates, Cook County, Illinois where the faulty baler was installed and operated.

The plaintiff accuses the defendants of negligence and breach of duty in designing, manufacturing, advertising, distributing, selling, installing and maintaining their products. The complaint highlights the absence of adequate safeguards or safety cut-off devices on the baler which led to Catalan's traumatic injuries.

Catalan is seeking judgment against both defendants for an amount exceeding $50,000. He claims to have suffered personal and pecuniary losses including economic losses, medical expenses, pain and suffering, disfigurement and disability due to the incident.
