In the United States District Court, Northern District of Illinois, Eastern Division, a lawsuit has been filed by plaintiff Francine Welborn, as representative of the estate of Lovelle Antonio Jordan, against defendants Charles Truitt, Warden of the Stateville Correctional Center, and unknown Joe Doe correctional officers. The court case ID is 1:24-cv-03165 and it was filed on April 19th, 2024.
The lawsuit revolves around the death of Lovelle Antonio Jordan while in custody at the Illinois Department of Corrections (IDOC). Represented by attorneys Erickson & Oppenheimer, Welborn alleges that Jordan's rights under the U.S. Constitution were violated resulting in his death. Jordan was a paraplegic prisoner who died from being hung by the neck on April 19th, 2022.
The defendants are accused of failing to adequately screen Jordan for depression or suicidal ideation and not properly observing or monitoring him. As a result of these alleged actions, Welborn claims that she suffered injuries including legal fees, loss of freedom during arrest and prosecution, humiliation, embarrassment, deprivation of constitutional rights and dignity, lost time and employment income and opportunities.
Welborn is seeking remedies from the defendants for the deprivation of Jordan’s rights under the U.S. Constitution which resulted in his death. She seeks both actual damages sustained as well as exemplary damages due to what she claims was a deliberate and malicious deprivation of his Constitutional rights.
