Plaintiff Marcius Cruz has filed a lawsuit against Fox Security, Inc. in the United States District Court for the Northern District of Illinois, Eastern Division. The case, identified as 1:24-cv-04035 and filed on May 16, 2024, alleges race and national origin-based discrimination, harassment, and retaliation under the Civil Rights Act of 1964.

According to the complaint filed by attorney Travis P. Lampert from Sulaiman Law Group Ltd., Cruz worked as a security officer for Fox Security from March 14, 2023, through February 24, 2024. Cruz claims that he was subjected to different terms and conditions of employment compared to non-Caucasian employees and faced a hostile work environment due to his ethnicity and national origin. He further alleges that his referrals of Caucasian and Hispanic candidates were ignored while African American candidates were favored.

Cruz also states that after raising concerns about discriminatory comments made by an African American field supervisor on January 29, 2024, he was reassigned to a less favorable location two hours away from his home with reduced working hours. This reassignment led to his termination on February 24, 2024.

The plaintiff seeks back pay with interest, front pay and benefits, compensatory and punitive damages, reasonable attorneys' fees and costs, pre-judgment interest if applicable, and any other relief deemed just by the court.
