Local Resident Accuses Popular Restaurant Chain of Disability Discrimination

A local resident has filed a lawsuit against a popular restaurant chain, alleging discrimination based on disability. Lois White lodged the complaint in the United States District Court for the Northern District of Illinois on August 19, 2024, accusing Rock Bottom Group, LLC of violating the Americans with Disabilities Act (ADA).

Lois White, who resides in Cook County, Illinois, claims that her visit to Rock Bottom Restaurant and Brewery in Orland Park was marred by multiple accessibility barriers. According to the complaint, White suffers from arthritis of the lumbar spine and osteoarthritis of the right knee—conditions that significantly limit her mobility and require occasional use of mobility aids. Despite these challenges, she continues to travel frequently to Orland Park for social visits and shopping.

During her visit to Rock Bottom Restaurant and Brewery on July 28, 2024, White encountered several obstacles that she believes violate ADA standards. The complaint details numerous architectural barriers within the facility's women's restroom and seating areas. For instance, she noted issues such as improper maneuvering clearance at restroom doors, lack of insulation under sinks causing balance difficulties, and inadequate spacing between grab bars which are essential for her stability.

White's grievances extend beyond physical barriers; she also alleges systemic issues with the restaurant's policies and procedures regarding ADA compliance. "Despite advertising that Rock Bottom Restaurant and Brewery is accessible," White stated in her filing, "I encountered barriers to access at their Orland Park Facility." She emphasized that these barriers deter her from considering the facility as a dining option in future visits.

The plaintiff is seeking both declaratory and injunctive relief from the court. Specifically, she requests an order declaring that Rock Bottom Group violated ADA provisions by failing to remove architectural barriers and modify its policies accordingly. Additionally, White seeks an injunction requiring the defendant to make necessary modifications to ensure full compliance with ADA standards.

White's legal representation is being handled by Angela C. Spears of Cass Law Group P.C., based in Frankfort, Illinois. The case has been assigned Case No. 1:24-cv-7412.
