Former Employee Alleges Discrimination Against United Ground Express Under ADA

Larissa Marcano has taken legal action against her former employer, alleging discrimination and retaliation under the Americans with Disabilities Act (ADA). On October 29, 2024, Marcano filed a complaint in the United States District Court for the Northern District of Illinois against United Ground Express, Inc., accusing them of discriminatory practices based on her disability.

Marcano's lawsuit outlines several grievances against United Ground Express. She claims that despite being qualified to perform her job as a time and attendance administrator, she faced discrimination due to her autism. According to the complaint, Marcano was employed by the company from January 16, 2023, until her termination on August 30, 2024. The plaintiff alleges that an incident involving a lighthearted remark made to comfort a distressed colleague was reported to management and used as a pretext for her dismissal. "If you cry, I'll cry," she had said jokingly, but this led to accusations of unprofessional conduct.

The complaint further asserts that United Ground Express failed to accommodate Marcano's known disability and engaged in harassment based on her condition. The company's actions allegedly violated both the ADA and the Illinois Human Rights Act (IHRA), disregarding Marcano's rights as a disabled individual. The plaintiff contends that she was treated less favorably than other employees outside her protected class and was subjected to unlawful termination in retaliation for asserting her rights under the ADA.

Marcano is seeking various forms of relief from the court. She requests back pay with interest, compensation for lost benefits, front pay, and both compensatory and punitive damages. Additionally, she seeks reasonable attorneys' fees and costs associated with the case. The plaintiff also demands a jury trial to resolve these issues.
