Plaintiff alleges Skyline Business Solutions violated ADA and Title VII

A former employee has taken action against her previous employer, alleging severe misconduct and discrimination. Daniaja Livingston filed a complaint in the United States District Court for the Northern District of Illinois on November 5, 2024, accusing Skyline Business Solutions, Inc. of multiple violations under the Americans with Disabilities Act (ADA) and Title VII of the Civil Rights Act of 1964.

Livingston's lawsuit outlines serious allegations against Skyline Business Solutions, where she worked as a Human Resources Administrative Recruiter from September 25, 2023, until her termination on April 18, 2024. The plaintiff claims that despite her ability to perform essential job functions with or without accommodations due to her asthma—a recognized disability—she faced discrimination when the company failed to provide reasonable accommodations. Livingston further asserts that she was terminated in retaliation for requesting time off for surgery related to her condition.

The complaint also details an unsettling account of sexual harassment by a co-worker named Vincent. Livingston alleges that from January 2024 onwards, Vincent subjected her to inappropriate behavior and comments about her personal life and body. Despite reporting these incidents to Skyline’s HR department and owner Jared (last name unknown), no substantial action was taken; instead, she was falsely informed that Vincent had been terminated. The harassment continued unabated until March 15, 2024, when Vincent reappeared at work.

Livingston accuses Skyline Business Solutions of fostering a hostile work environment based on sex discrimination and failing to act on complaints about sexual harassment. She describes feeling unsafe and unsupported after management dismissed her concerns with statements like "We really need this guy," indicating their unwillingness to address the harassment adequately.

The lawsuit seeks various forms of relief from the court including back pay with interest, compensatory and punitive damages, loss of benefits compensation, attorney fees, and any other relief deemed appropriate by the court. Livingston demands a jury trial to resolve these issues.
