Former Warehouse Manager Alleges Discrimination Against Logistics Company Under ADA

A former warehouse manager has taken legal action against his previous employer, alleging discrimination and retaliation related to his disability. Kevin Johnson filed a complaint in the United States District Court for the Northern District of Illinois on November 22, 2024, against Elite XPO Cargo Systems, Inc. The lawsuit accuses the company of violating both the Americans with Disabilities Act (ADA) and the Family and Medical Leave Act (FMLA).

According to the complaint, Johnson began working for Elite XPO Cargo Systems as a warehouse manager on March 8, 2022. His responsibilities included overseeing warehouse operations and managing trade show exhibits. Despite being qualified for his role, Johnson claims he faced discrimination due to his anxiety disorder—a recognized disability under the ADA. The lawsuit states that Johnson's condition required medical treatment and accommodations from his employer.

In September 2024, a change in medication led to a setback in Johnson's health, prompting his doctor to recommend intensive outpatient therapy. Johnson informed Elite XPO Cargo Systems of his need for leave due to this medical advice. However, he alleges that instead of accommodating his request or engaging in an interactive process as mandated by law, the company terminated him on September 30, 2024.

The complaint further contends that Elite XPO Cargo Systems failed to inform Johnson about his FMLA rights or provide necessary information regarding leave eligibility. This alleged failure constitutes interference with FMLA rights and is claimed as another basis for unlawful termination.

Johnson seeks various forms of relief from the court including back pay with interest, front pay, compensatory and punitive damages, loss of benefits compensation, attorney fees, and any other relief deemed appropriate by the court.
