Eric Pike has filed a class action lawsuit against Tecta America Corp., alleging that the company failed to adequately protect his and other customers' personally identifiable information (PII) in a significant data breach. The complaint was filed on January 22, 2025, in the United States District Court for the Northern District of Illinois. Pike accuses Tecta America Corp. of negligence and failing to secure sensitive information such as Social Security numbers, driver's licenses, and financial account details.
According to the complaint, Tecta America Corp. discovered suspicious activity on its network on October 1, 2024, revealing that hackers had infiltrated its systems between September 20 and October 2, 2024. The cybercriminals allegedly accessed files containing PII of Eric Pike and other class members. Despite this breach, Tecta only offered one year of credit monitoring services to affected individuals and advised them to remain vigilant against identity theft and fraud. "We encourage you to remain vigilant against incidents of identity theft and fraud," the company stated in its notification letter.
Pike argues that Tecta's cybersecurity measures were grossly inadequate, allowing hackers prolonged access to their systems without detection. He asserts that the company should have implemented more robust security protocols such as endpoint detection and response tools, centralized logging systems, and encryption methods for sensitive data like Social Security numbers. The plaintiff contends that these failures violated consumer protection laws under the Federal Trade Commission Act (FTCA) by not using reasonable measures to safeguard customer data.
The lawsuit seeks various forms of relief from the court, including compensatory damages exceeding $5 million for affected individuals due to negligence and breach of implied contract by Tecta America Corp. Additionally, Pike demands injunctive relief requiring Tecta to improve its cybersecurity practices significantly. This includes implementing comprehensive information security programs and conducting regular audits by independent third-party assessors.
