The plaintiff argues that such changes are not only necessary but also feasible without significant difficulty or expense. Citing Title III of the ADA, Aigner emphasizes that injunctive relief should include both physical alterations to make facilities accessible and policy modifications to ensure ongoing compliance.
Representing a nationwide class of wheelchair users who have encountered similar barriers at AG Bells' locations, Aigner aims to compel systemic changes through this litigation. Her attorneys are seeking declaratory judgment on ADA violations and prospective injunctive relief to enforce compliance across all affected sites. They also request class certification and attorney fees as part of the court's judgment.
