Constance Henry, a visually-impaired individual, has filed a class action lawsuit against HRSH Acquisitions, LLC, doing business as Alloy Apparel & Accessories. The complaint was lodged in the United States District Court for the Northern District of Illinois on February 6, 2025. Henry alleges that the defendant's website is not accessible to blind and visually-impaired individuals, violating their rights under the Americans with Disabilities Act (ADA).
The plaintiff, Constance Henry, who requires screen-reading software to access digital content due to her visual impairment, claims that HRSH Acquisitions' website—Alloyapparel.com—contains significant barriers that prevent blind users from independently navigating and making purchases. These barriers include inaccessible drop-down menus, lack of alternative text for images, and elements requiring mouse interaction rather than keyboard accessibility. According to Henry's complaint, these issues effectively exclude visually-impaired customers from accessing goods and services available to sighted users.
Henry asserts that the defendant's failure to make its website accessible is a violation of both state and federal laws designed to ensure equal access for individuals with disabilities. She points out that despite readily available technology solutions used by other retailers to make websites accessible through features like alternative text and resizable text options, HRSH Acquisitions has neglected to implement such measures. This oversight denies blind customers full participation in online commerce—a critical aspect of modern life given mobility challenges faced by many visually-impaired individuals.
The lawsuit seeks several forms of relief: a permanent injunction requiring HRSH Acquisitions to modify its website policies and practices to comply with ADA standards; compensatory damages for those affected by the alleged discrimination; punitive damages; and coverage of legal costs. Additionally, Henry requests nominal damages and pre- and post-judgment interest as part of the compensation package.
