The case revolves around an incident that began on October 11, 2019, when Avenaim underwent shoulder surgery at Mount Sinai Hospital. The plaintiff claims that despite being cleared for surgery by his primary care physician with known hypertension controlled by medication, post-operative care was inadequate. Avenaim's blood pressure was reportedly elevated after surgery, leading to confusion and headaches. Despite these symptoms, the medical team failed to control his blood pressure effectively or investigate further with neurological consultations or imaging studies like MRI or CTA scans.
The lawsuit alleges multiple instances of negligence: failure to manage hypertension adequately, not ordering necessary diagnostic tests, and not addressing new symptoms such as headaches and vision problems. These oversights allegedly resulted in Avenaim developing posterior reversible encephalopathy syndrome (PRES), a serious condition affecting brain function.
Plaintiff's attorney Colin H. Dunn argues that the defendants breached their duty of care through these failures. The lawsuit seeks damages exceeding $50,000 for personal injuries and permanent damage suffered by Avenaim due to the alleged negligence.
