The lawsuit alleges negligence and negligent supervision after Clark was assaulted by another resident while visiting her aunt at the facility.
The events leading to this legal action unfolded on July 5, 2024. Paulette Clark was visiting her aunt at the Orland Park Skilled Nursing Facility when she was allegedly attacked by another resident identified only as Jane Doe. According to the complaint, Jane Doe intentionally assaulted Clark with a wheelchair, resulting in severe injuries including a sprained ankle, broken bones in her foot, and a torn rotator cuff. Despite informing the facility of previous threats made by Jane Doe in June 2024 after an altercation over personal belongings in her aunt's room, no preventive measures were taken.
Clark accuses the nursing facility of failing to maintain a safe environment for its residents and visitors. "Defendant ORLAND PARK SKILLED NURSING FACILITY, LLC breached their duty and was negligent," states the complaint. The allegations include failure to maintain safe premises, inadequate warning of dangerous conditions, and insufficient response to known hazards. Furthermore, Clark asserts that there was negligent supervision on part of the facility’s staff who failed to manage aggressive residents properly.
The plaintiff seeks judgment against Orland Park Skilled Nursing Facility for damages exceeding $50,000 along with litigation costs. The lawsuit emphasizes that due care was not exercised by the defendants to prevent open and obvious dangers that could cause bodily harm within their premises.
