A customer is suing a Dallas-based Whirlyball operator, saying he sustained injuries while using the facility's allegedly defective equipment.
James Egan filed a complaint July 1 in Cook County Circuit Court against Whirlyball Mid-Cities, alleging negligence. While a licensed Whirlyball operator, the Dallas facility bears no business relationship with the operators of the Chicago area Whirlyball locations.
According to the complaint, on July 1, 2013, Egan, a Cook County resident, was at the defendant's Dallas location for a corporate event playing Whirlyball, described as a mix of basketball and lacrosse that's played in bumper cars. The suit says Egan injured his hand due "to a defective handle on the cart he was going to operate" and while being treated, he also was diagnosed with peripheral vestibulopathy.
The lawsuit states the defendant had a duty to provide safe equipment, and failed to inspect the cart before Egan used it, address the defective part, and keep patrons from using unsafe equipment.
Egan seeks damages of more than $50,000, plus costs. He is represented by Driscoll Law Offices in Naperville.
