Cook County woman sues nursing home, alleing negligence

A Cook County woman is suing a nursing home and its financial backers, alleging negligence in the death of a resident.

Adrena Moore, on behalf of Claudia Nimocks (deceased), filed a lawsuit Aug. 18 in Cook County Circuit Court against the Villa at Windsor Park Nursing and Rehab Center, doing business as Villa at Windsor Park, Platinum Asset Management, Legacy Healthcare Financial Services and Peace Hospice and Palliative Care, doing business as HBA of Illinois, alleging neglect under the provisions of the Illinois Nursing Home Care Act.

According to the complaint, Claudia Nimocks, a resident of Villa at Windsor Park, 2649 E. 75th St., Chicago, from 2007 until her death Aug. 31, 2013, had a condition requiring special supervision and assistance with daily activities, and she was at high risk for falls, accidents and the development of pressure sores. The suit says the nursing home’s staff was aware of Nimocks’ condition.

However, the lawsuit states Nimocks suffered two falls, a broken right femur and an “unstageable” pressure sore in the days before her death. 

The suit charges negligence under the Nursing Home Care Act, alleging failure to provide adequate personal or medical care resulting in physical or mental injury to a resident.

Moore seeks $50,000 in damages, plus attorney fees and costs. She is represented by attorneys from Levin & Perconti in Chicago.
