Blujay Studios Accuses Online Marketplaces of Trademark Infringement

In a compelling legal battle that highlights the growing issue of online counterfeiting, a company has taken decisive action against numerous unnamed defendants. On September 26, 2024, Blujay Studios, Inc. filed a complaint in the United States District Court for the Northern District of Illinois against various partnerships and unincorporated associations identified on Schedule "A" of their filing. The defendants are accused of selling counterfeit products bearing Blujay's registered trademarks through online marketplaces.

Blujay Studios, known for its APHMAU/MEEMEOW brand associated with plush toys and gaming merchandise, alleges that these defendants have been exploiting its trademarks to sell counterfeit goods. The company holds several U.S. Trademark Registrations for its APHMAU/MEEMEOW Trademarks, which it claims are being infringed upon by these unauthorized sellers. According to the complaint, the defendants operate interactive commercial internet stores targeting U.S., particularly Illinois consumers, with counterfeit versions of Blujay's products.

The lawsuit outlines how these counterfeit operations not only damage Blujay's reputation but also pose significant challenges due to the anonymity provided by e-commerce platforms. As stated in the complaint, "the rise of online retailing...has made it nearly impossible for policing actions to be undertaken." The document details how these illegal activities are conducted through coordinated supply chains and distribution networks that unfairly compete with legitimate businesses while generating substantial profits for those involved in counterfeiting.

Blujay is seeking both injunctive relief and monetary damages from the court. They request that the court enjoin the defendants from further use of their trademarks and demand an accounting of all profits derived from these unlawful acts. Additionally, they seek statutory damages amounting to $2 million per infringement as well as compensation for attorney fees and costs incurred during this legal process.
