GS Holistic, LLC has taken legal action against a local vape shop for allegedly selling counterfeit products. The lawsuit was filed by GS Holistic, LLC in the United States District Court for the Northern District of Illinois on September 26, 2024, targeting EJA Vapes, Inc., which operates under the name Glassy Vapes, and its owner Joseph Rayan.
The complaint accuses EJA Vapes and Joseph Rayan of trademark infringement, counterfeiting, false designation of origin, and unfair competition under the Lanham Act. GS Holistic claims that since 2012 it has been marketing products under the "G Pen" brand, known for high-quality vaporizers. They allege that Glassy Vapes sold counterfeit versions of these products with fake G Pen trademarks. On October 3, 2022, an investigator from GS Holistic purchased a vaporizer from Glassy Vapes that bore G Pen marks but was identified as counterfeit upon inspection.
GS Holistic argues that the sale of these counterfeit goods damages their brand's reputation and leads to consumer confusion. They assert that Glassy Vapes’ actions have caused them significant financial losses and irreparable harm to their brand image. The plaintiff seeks injunctive relief to prevent further sales of counterfeit products by the defendants and demands statutory damages along with costs incurred due to this lawsuit.
