Setoffs for other insurance recovered in dramshop cases where bar owners are defended by the Illinois Insurance Guaranty Fund apply against the owners’ maximum statutory liability and not jury verdicts, the Illinois Supreme Court held today.
Duane Kuipers filed suit Nov. 5 in the Cook County Circuit Court against the Northeast IL Regional Commuter Railroad Corp., Rail Division of the Regional Transportation Authority, doing business as Metra, Millennium Station at Randolph, City of Chicago, Chicago Park District and Beitler Millennium Station LLC.
