Cook County man's estate seeks restitution over wrongful death claims

The estate of a Cook County man who perished in a motorcycle accident seeks restitution for his alleged wrongful death.

The estate of Manuel Duenez and Angelica Morales, independent administrator of the estate of Manuel Duenez, deceased, filed suit on Sept. 16 in Cook County Circuit Court, Law Division against Fierge Auto Parts Co. and Michael Newberry.

According to the complaint, on Sept. 18, 2013, Duenez was riding on a motorcycle westbound on Lake Street in Bartlett when Newberry, also traveling west on Lake Street in a tow truck owned and operated on behalf of Fierge Auto Parts, allegedly collided with Duenez, causing him to fall to the ground, causing grave injuries and eventually leading to his untimely demise.

The plaintiff charges Newberry and his employers with wrongful death, citing negligence and other damages, including survival action on behalf of his loved ones. They seek restitution for his pain and suffering and their own, plus medical expenses, funeral expenses, and court costs and attorney fees.

The plaintiff seeks an amount substantially of more than $30,000, in an amount necessary to fully and fairly compensate the estate all losses compensable under the terms of the survival statute.

The plaintiff is being represented by Charles N. Thurman of Thurman Law Offices LTD of Chicago.
